NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Butte-Silver Bow Zoning Board of Adjustment will hold a public hearing on Thursday July20, 2023, at 5:30 p.m., Council Chambers, Third Floor, Room312, Butte-Silver Bow Courthouse, Butte, Montana, to hear an application for two (2) Special Use Permits and five (5) variance applications as per Title 17 (Zoning) of the Butte-Silver Bow Municipal Code (BSBMC).
SPUSE-23-000007 – A Special Use Permit application by Aaron Hildreth owner of Whitehall, MT. The proposed application is to construct an assisted living facility as per Section 17.38.180 –Special Uses Allowed of the BSBMC. The property is in an “R-3”(Multi-Family Residence) zone with a small portion of the southern section in the C-2 (Community Commercial) zone, legally described as S33, T03 N, R07 W, POR of LOT 4,MIDNIGHT #9883. This Special Use Permit is substantially similar to the Special Use Permit approved for this project in 2021and subsequently expired due to no permits being issued.
VARIANCE-23-000002 - An application for a variance by Aaron Hildreth to allow Beehive Homes to install in lieu of a three-foot masonry wall or solid wood fence, conifer shrubbery of sufficient height to be provided to prevent vehicle lights from having a negative effect on neighboring residential property owners. In anR-3 “multi-Family residential zone,” varying from the permitted uses in the zone in Section 17.16.020- Permitted Uses, of the Butte-Silver Bow Municipal Code (BSBMC). The location of the proposal is S33, T03 N, R07 W, POR of LOT 4, MIDNIGHT#9883.
SPUSE-23-000010 – A Special Use Permit application by Julie A. Buckley, owner of 2010 Gaylord St., Butte, MT. The proposed application is to locate a short-term rental in an existing residence at 2010 Gaylord St., Butte MT as per Section 17.38.180 – Special Uses Allowed of the BSBMC. The subject property is in an “R-1”(One-Family Residence) zone, legally described as Gallatin Add.,S19, T03 N, R07 W, Block 25, Lot 21-22.
VARIANCE-23-000004 – An application by the Bert-Mooney Airport for a variance to relocate an existing off-premise sign in the R1-S zoning district, per Section 17.08 of the BSBMC. The subject property is part of the Bert-Mooney airport land, legally described as McQueeney Sub, S05, T02 N, R07 W, Block 13,Por N2, Por SE4, McQueeney Sub- Por Blocks 13,16.
VARIANCE-23-000005 – An application by Crown West Development, property owners, for a variance a three-unit dwelling on two adjacent platted lots that measure 30’x100’ and44’x100’, totaling 7,400 square feet with 74 feet of frontage width. This application requests to vary from the required 80 feet of frontage for multifamily units in the R-3 zone (BSBMC Section17.14.060) as well as the required 9,000 square feet of lot area required for 3-unit dwellings in the R-3 zone (BSBMC Section17.14.050). The subject property is at the southeast corner of Jackson and Platinum Streets, legally described as Travonia Fraction, S13, T03 N, R08 W, Block 4, Lot 10-11.
VARIANCE-23-000006 - An application by Clint McGee, property owner, 2401 East Lake Drive, Butte, MT, to construct a 21-foot,8-inch tall garage in an R-1 (One-Family Residence) Zone, varying from the 16-foot maximum permitted height of accessory structures in the R-1 zone, per BSBMC Section 17.10.040). The subject property is located at 2401 E Lake Drive, legally described as Atherton Place Add., S33, T03 N, R07 W, Block 61,Lots 8-10.
VARIANCE-23-000007 - An application by Suzanne and Michael Hall, property owners, 1125 Motor View Road, Butte, MT, to construct a 21-foot tall garage in the R-2 (Two-Family Residence)Zone, varying from the 16-foot maximum permitted height of accessory structures in the R-2 zone, per BSBMC Section17.12.040. The subject property is located at 1125 Motor View Road, legally described as Gall Minor Sub, S06, T02 N, R07 W, Lot 1, Plat 235 A.
VARIANCE-23-000008 - An application by Gina and Frank Fleming, property owners, 203 Vista Court, Butte, MT, for a variance to construct a garage with a minimum 5-foot side yard setback in the R1-S “One-Family Suburban Residence Zone.” This application requests to vary from the 15-foot required side yard setback in the R1-S zoning district, per Section 17.08.080 of the Butte-Silver Bow Municipal Code (BSBMC). The subject property is located at 203 Vista Court, legally described as Green Acres, S16, T02 N, R07 W, Block 4, Lot 8.
